Terms of service

Welcome to Never Bored Studio! These terms explain how our shop works and what we each agree to when you visit our website or buy from us. We've kept them as plain as we can, so please read them before you order.

1. Who we are

"Never Bored Studio," "we," "us" and "our" mean Never Bored LLC, a New York limited liability company. We run this website and online store, including everything on it (together, the "Services"). Our store is powered by Shopify Inc., but every purchase you make here is made directly with us.

By visiting, browsing or buying through the Services, you agree to these Terms of Service and to our Privacy Policy, both posted on this site. If you don't agree, please don't use the Services. Nothing in these terms limits any rights you have under consumer protection laws or other laws that can't be waived.

2. Your account and information

To use the Services, you must be at least 18 or the age of majority where you live. If you let a minor in your household use the Services on your device, you're responsible for that use.

When you buy from us, we'll ask for information such as your email address and your billing and shipping details. Please make sure it's accurate and up to date. If you create an account, keep your login secure. You're responsible for activity on your account, and you can't transfer it to anyone else.

3. Our products

Everything in our shop is designed and hand-drawn by us and made with care. Because our work is handmade, and because every screen shows color a little differently, the item you receive may vary slightly from the photos. We do our best to show each item accurately, but we can't promise it will look exactly as it does on your screen.

We may change product descriptions, discontinue items or limit quantities at any time.

4. Orders

When you place an order, you're offering to buy the items in your cart, and you authorize us and our payment processors to charge your payment method for the total. An order is accepted once we confirm it and your payment is processed. We may decline or cancel any order, for example if an item is out of stock, a price was listed in error, or we suspect fraud. If we cancel an order after you've paid, we'll refund you in full.

Please review your order before you submit it. We'll do our best to help with changes, but we may not be able to change or cancel an order once it's accepted. Returns and exchanges are handled under our Refund Policy.

Our products are sold for personal or household use, not for resale. If you'd like to carry Never Bored products in your shop, ask us about wholesale at hello@neverboredstudio.com.

5. Custom commissions and personalized orders

Commissions are custom pieces we create just for you, such as pet portraits, home and building portraits, wedding invitations and custom gifts.

  • Quotes and payment. Each commission starts with a quote that sets out the work, price, timeline and payment terms (such as a deposit). Work begins once you accept the quote and pay as agreed.
  • Cancellations. You can cancel for a full refund before work begins. Once work has begun, custom and personalized orders are final sale and can't be returned or refunded.
  • Sketches and proofs. We'll share sketches or proofs along the way, and your quote says how many rounds of revisions are included. Please check every proof carefully, including names, dates, spelling and addresses. We produce what you approve and aren't responsible for errors in an approved proof.
  • Photos and materials you send. When you send photos or other reference material, you confirm that you own them or have permission to share them, and you allow us to use them to create your piece.
  • Timelines. Turnaround times are estimates. We'll keep you posted along the way, and we'll share any holiday order-by dates when you book.
  • Copyright and sharing. We keep the copyright in every design we create. You own the physical piece and may display it, gift it and share photos of it for personal, non-commercial purposes. We may show commissioned work in our portfolio and on social media; if you'd rather we didn't, just tell us when you book. We'll never post personal details from your piece, such as addresses on wedding invitations, without your permission.
  • Our discretion. We may decline any commission request.

6. Prices, payment and gift cards

All prices are in U.S. dollars. Prices, discounts and promotions may change at any time, but you'll pay the price shown when you place your order, as listed in your order confirmation email. Unless we say otherwise, prices don't include sales tax or shipping, which are calculated at checkout. Promotions may have their own terms; if they conflict with these terms, the promotion's terms apply. Prices online may differ from prices at events, at our retail partners or on other marketplaces.

Payment is collected in full when you order, except for commissions, which follow the payment terms in your quote. By paying, you confirm that you're authorized to use your payment method and that your payment information is accurate.

Gift cards are delivered by email, don't expire, and can't be exchanged for cash except where the law requires. Please treat a gift card like cash: we can't replace one that's lost or used without your permission.

7. Shipping and delivery

We're a small, independent studio, and we pack every order by hand. Processing and shipping times are shown on our site, and you'll get an email when your order ships, with tracking when it's available.

Delivery dates are estimates and aren't guaranteed. Once we hand your package to the carrier, ownership and risk of loss pass to you, unless the law says otherwise. We're not responsible for delays caused by carriers, customs, or events beyond our reasonable control, such as severe weather, natural disasters, supply shortages or outages. If you order from outside the U.S., any customs duties and import taxes are your responsibility. If your order arrives damaged, see our Refund Policy, and see our Shipping Policy for more details.

8. Studio closures

From time to time we close the studio or pause shipping for travel or the holidays. We'll post the dates on our site before a closure begins. Orders placed during a shipping pause ship after we return, and some or all items may be unavailable while we're closed.

9. Pop-ups, events and retail partners

Purchases at our craft fairs, festivals and pop-up events follow these terms unless we tell you otherwise at the time of sale. Never Bored products are also sold by independent shops. If you buy from one of them, that shop's own policies apply to your purchase.

10. Our art and intellectual property

All artwork, designs, illustrations, text, photos, logos and other content on the Services are original work owned by Never Bored LLC or its licensors, and they're protected by U.S. and international copyright, trademark and other laws. "Never Bored," our logo and our slogans are our trademarks.

Buying a product gives you the product itself, not any rights in its design. You may use the Services and our products for personal, non-commercial purposes only. You may not reproduce, copy, scan, trace, modify, distribute or resell our designs or content, or use them to train or prompt AI tools, without our written permission. Shopify's name and logo are Shopify's trademarks, and other names and logos on the Services belong to their owners.

11. Reviews, feedback and messages

If you send us reviews, feedback, ideas or other content ("Feedback"), you give us a perpetual, worldwide, royalty-free license to use, copy, edit, publish and display it, including to promote our shop. We don't have to keep Feedback confidential, pay for it or respond to it, and we may edit or remove any Feedback we find unlawful, offensive or in violation of these terms. (This section doesn't cover photos and materials you send for a commission; section 5 covers those.)

When you send Feedback, you confirm that it's your own and honest, that you've disclosed any payment or incentive you received for it, and that it doesn't violate anyone's rights or contain anything harmful, such as a virus. Please don't use a false email address or pretend to be someone else.

12. Emails from us

By placing an order or using the Services, you agree that we may contact you electronically about your orders, your account and these terms, for example with order confirmations and shipping updates. Marketing emails are separate: you'll get them only if you sign up, and you can unsubscribe at any time using the link in any email. Please keep your contact information current.

13. Privacy and our relationship with Shopify

Our Privacy Policy explains how we collect, use and share your personal information. Our store is hosted by Shopify, so when you browse or buy, Shopify also collects and processes information about your visit and purchase, for example to run the store, process payments and help prevent fraud. This information may be shared with Shopify and with third parties located outside your country. See our Privacy Policy and Shopify's privacy policy for details.

Every purchase you make here is made directly with Never Bored Studio. Shopify isn't responsible for any part of your purchase, including any injury, damage or loss related to products you buy, and you release Shopify and its affiliates from all claims arising from your purchases from us.

The Services may include tools or links provided by third parties, such as payment, shipping or social media services. We don't control them and provide them "as is," without any warranty or endorsement. You use them at your own risk and under their own terms, and questions about them should go to the third party. New features we add to the Services are also covered by these terms.

15. Using the Services responsibly

You may use the Services only for lawful purposes. You may not:

  • break any law or regulation, or infringe our rights or anyone else's;
  • harass, abuse, threaten or defame anyone, including us;
  • submit false or misleading information, or impersonate anyone;
  • send spam, chain letters or unsolicited advertising;
  • upload viruses or other malicious code, or get around the security of the Services;
  • collect other people's personal information;
  • copy, resell or exploit any part of the Services; or
  • use robots, scrapers, data-mining tools or AI tools to access or extract content from the Services, except as allowed in section 16.

We may suspend or end your access at any time if you break these terms.

16. Automated agents

These rules apply if you use or allow any software agent, including an AI agent, that acts on someone's behalf without direct supervision to access or interact with the Services. An agent must:

  • identify itself in every web request by including "Agent/[agent name]" in its user agent string;
  • never hide that it's an agent, for example by mimicking human behavior or getting around CAPTCHAs;
  • answer truthfully if asked whether it's a person or a computer; and
  • respect any measure we use to limit or block agents, and stop if we ask it to.

We may limit how agents use the Services, including by technical means.

17. Errors

Our site may occasionally contain errors in product descriptions, prices, promotions, shipping charges, transit times or availability. We may correct errors and update information at any time, and we may cancel orders affected by an error, even after you've ordered. If we cancel an order you've paid for, we'll refund you in full.

18. Ending access

We may end these terms or your access to the Services at any time, without notice. You'll still owe any amounts due. Sections that by their nature should continue, including those on intellectual property, feedback, disclaimers, liability, indemnification and governing law, will continue to apply.

19. Disclaimer of warranties

Information on the Services is provided for general purposes only. We don't guarantee that it's accurate, complete or useful, and you rely on it at your own risk.

Except as expressly stated by Never Bored Studio, the Services and all products offered through them are provided "as is" and "as available," without representations, warranties or conditions of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We don't promise that your use of the Services will be uninterrupted, timely, secure or error-free. Some places don't allow these disclaimers, so they may not apply to you.

20. Limitation of liability

To the fullest extent permitted by law, Never Bored Studio and our owners, employees, affiliates, agents, contractors, service providers and licensors, and Shopify and its affiliates, will not be liable for any injury, loss or claim, or for any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, lost data or replacement costs, whether based on contract, tort (including negligence), strict liability or otherwise, arising from your use of the Services or any product, even if we were told such damages were possible. Nothing in these terms excludes or limits liability that can't be excluded or limited by law.

21. Indemnification

You agree to defend, indemnify and hold harmless Never Bored Studio, Shopify, and our affiliates, partners, owners, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, brought by a third party because of (1) your breach of these terms or the policies they include, (2) your violation of any law or anyone's rights, or (3) your use of the Services.

We'll notify you of any such claim; a delay in notifying you doesn't relieve you of these obligations unless it materially harms you. You'll cooperate in the defense, including by providing relevant documents. We may control the defense at your expense, but we won't settle a claim that requires you to do anything other than pay money without your consent, which you won't unreasonably withhold.

22. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. You and Never Bored Studio agree to the jurisdiction and venue of the state and federal courts located in New York, except where the law doesn't allow it. Nothing here limits your right to bring a claim in your local courts or to rely on mandatory laws where you live.

23. General terms

  • Severability. If any part of these terms is found unenforceable, it will be enforced to the fullest extent allowed and the rest stays in effect. If any part conflicts with consumer rights that can't be waived, those rights apply.
  • No waiver. If we don't enforce a right or provision, we haven't given it up.
  • Entire agreement. These terms and the policies posted on this site are the entire agreement between you and us about the Services, and they replace any earlier agreements or versions. Any unclear wording won't be interpreted against us as the drafter.
  • Assignment. You can't transfer your rights or obligations under these terms without our written consent. We may transfer ours without notice to you.
  • Translations. If these terms are offered in another language and the versions conflict, the current English version controls.
  • Headings. Headings are for convenience only and don't change the meaning of these terms.

24. Changes to these terms

You can always find the current version of these terms on this page. We may update them at any time by posting changes here, so please check back from time to time. We'll notify you of material changes as the law requires, and changes take effect on the date stated. If you keep using the Services after changes are posted, you accept them.
